1. はじめに／Introduction

本プライバシーポリシーは、ラハイナーズ合同会社（以下「当方」といいます。）が提供する「おはようカモメ」（以下「本アプリ」といいます。）における、利用者の個人情報その他の情報の取扱いについて定めるものです。

This Privacy Policy explains how Lahainars LLC (“we,” “us,” or “the Operator”) handles personal information and other information relating to users of “Ohayo Kamome” (the “App”).

2. 取得する情報と利用目的／Information We Collect and How We Use It

2.1 アカウントおよび認証情報／Account and Authentication Information

当方は、アカウントの登録、認証、本人確認、サポート対応および本アプリに関する通知のため、メールアドレス、アカウントID（カモメID）、内部ユーザーIDその他の認証情報を取得・利用します。パスワードの認証処理には外部の認証サービスを利用し、当方はパスワードを平文で保管しません。

We collect and use email addresses, account IDs (Kamome IDs), internal user IDs, and other authentication information for account registration, authentication, identity verification, support, and notices concerning the App. Password authentication is processed using an external authentication service, and we do not store passwords in plain text.

2.2 メッセージおよび連絡先情報／Messages and Contact Information

当方は、利用者間のメッセージ機能、既読表示および連絡先管理のため、メッセージ本文、表示名、送信日時、既読状態・既読日時、連絡先情報その他これらに関連する情報を取得・利用します。

We collect and use message content, display names, sent timestamps, read status and timestamps, contact information, and related information to provide messaging, read-receipt, and contact-management functions.

2.3 通知情報／Notification Information

当方は、新着メッセージその他本アプリに関する通知を配信するため、プッシュ通知用トークン、端末識別情報および通知設定を取得・利用します。通知は、利用者が端末上で許可した場合に送信されます。

We collect and use push-notification tokens, device identification information, and notification settings to deliver new-message alerts and other notices concerning the App. Notifications are delivered when permitted by the user on their device.

2.4 端末およびシステム情報／Device and System Information

当方は、不正利用の防止、利用端末の管理、利用回数の管理、障害調査およびシステム診断のため、端末識別情報、端末のモデル、OSの種類・バージョン、本アプリのバージョンその他のシステム情報を取得・利用します。

We collect and use device identification information, device model, operating-system type and version, App version, and other system information to prevent misuse, manage registered devices and usage limits, investigate failures, and diagnose the system.

2.5 決済およびサブスクリプション情報／Payment and Subscription Information

当方は、有料サービスの購入確認、有効性検証および利用権限の管理のため、購入情報、取引ID、購入証明情報、サブスクリプションの状態・有効期限その他決済に関連する情報を処理します。クレジットカード番号等の決済情報は各アプリストアの決済事業者が処理し、当方は保管しません。

We process purchase information, transaction IDs, proof-of-purchase information, subscription status and expiration dates, and other payment-related information to confirm and validate purchases and manage access to paid services. Payment information such as credit-card numbers is processed by the relevant application-store payment provider and is not stored by us.

2.6 音声データ／Voice Data

本アプリは、音声を文字へ変換する機能を提供します。利用する機能および端末の設定に応じて、音声データが端末のOSが提供する音声認識機能または当方が利用する外部の文字変換サービスへ送信される場合があります。外部サービスへ送信された音声データは、文字変換およびその処理に必要な範囲で利用され、国外で処理される場合があります。

The App provides a function that converts speech into text. Depending on the selected function and device settings, voice data may be sent to speech-recognition functions provided by the device operating system or to external transcription services used by us. Voice data sent to an external service is used to the extent necessary for transcription and related processing and may be processed outside Japan.

3. 端末権限の使用／Device Permissions

本アプリは、機能提供のため、次の端末権限を使用する場合があります。

• カメラ：連絡先追加用QRコードの読み取り。読み取ったカメラ画像は保存しません。
• マイク：音声入力および文字変換に使用する音声の録音。
• 音声認識：音声入力の文字変換。
• 通知：新着メッセージその他本アプリに関する通知の受信。

The App may use the following device permissions to provide its functions:

• Camera: To scan QR codes for adding contacts. Camera images used for scanning are not stored.
• Microphone: To record voice input for speech-to-text conversion.
• Speech Recognition: To convert voice input into text.
• Notifications: To receive new-message alerts and other notices concerning the App.

4. トラッキングおよび取得しない情報／Tracking and Information We Do Not Collect

当方は、位置情報、端末のアドレス帳、写真ライブラリまたは広告識別子を、本アプリの機能提供のために取得しません。また、第三者広告の配信または広告目的のトラッキングを行いません。

We do not collect location data, the device address book, photo-library data, or advertising identifiers to provide the App. We do not deliver third-party advertisements or track users for advertising purposes.

5. メッセージ情報の取扱い／Handling of Message Information

本アプリで送受信されるメッセージには、エンドツーエンド暗号化を採用していません。メッセージは、サービス提供、運用保守、サポート対応、障害調査および利用者保護のため、当方が必要に応じて内容を確認できる形式でサーバー上に保管されます。

Messages sent and received through the App are not end-to-end encrypted. They are stored on servers in a form that may be reviewed by us when necessary to provide and maintain the service, respond to support requests, investigate failures, and protect users.

古いメッセージは、保存数等が一定の上限を超えた場合、自動的に削除されることがあります。本アプリは、暗証番号、銀行口座情報、クレジットカード情報、認証コード、個人番号その他重要な機密情報の送信または保管には適していません。

Older messages may be automatically deleted when storage limits or other applicable limits are exceeded. The App is not suitable for sending or storing PINs, bank-account information, credit-card information, authentication codes, individual identification numbers, or other important confidential information.

6. 外部サービスの利用および国外での処理／External Services and Processing Outside Japan

当方は、本アプリの提供および運営のため、次のような外部事業者のサービスを利用します。

• Google LLC：認証、データベース、クラウド処理、通知配信および音声文字変換等
• Apple Inc.：アプリ配信、決済、サブスクリプション管理および端末機能等
• Google Playの決済事業者：アプリ配信、決済およびサブスクリプション管理等
• OpenAI, L.L.C.、Groq, Inc.その他の文字変換サービス提供者：音声の文字変換処理等

これらの外部事業者へ提供される情報は、各機能の提供に必要な範囲に限られます。情報は、日本国外に所在するサーバーまたは事業者により処理・保管される場合があります。当方は、委託先の選定および契約等を通じて、情報が適切に取り扱われるよう努めます。

We use external service providers, including the following, to provide and operate the App:

• Google LLC: Authentication, databases, cloud processing, notification delivery, speech-to-text conversion, and related services.
• Apple Inc.: Application distribution, payments, subscription management, and device functions.
• Google Play payment providers: Application distribution, payments, and subscription management.
• OpenAI, L.L.C., Groq, Inc., and other transcription providers: Speech-to-text processing and related services.

Information is provided to these service providers only to the extent necessary to provide the relevant functions. Information may be processed or stored by servers or service providers located outside Japan. We endeavor to ensure appropriate handling of information through provider selection, contractual arrangements, and other measures.

7. 情報の保管期間／Data Retention

当方は、取得した情報を、その利用目的の達成、サービスの提供、法令上の義務、障害・不正利用・紛争への対応その他正当な業務上の必要性がある期間に限り保管し、保管する必要がなくなった情報は合理的な方法で削除または匿名化します。メッセージは保存上限を超えた場合等に自動的に削除されることがあります。

We retain collected information only for as long as necessary to fulfill its purposes, provide the service, comply with legal obligations, respond to failures, misuse, or disputes, or meet other legitimate business needs. Information that is no longer required will be deleted or anonymized using reasonable methods. Messages may be automatically deleted when storage or other limits are exceeded.

8. アカウントおよびデータの削除／Account and Data Deletion

利用者は、本アプリの設定画面からアカウントを削除できます。アカウントを削除すると、アカウント情報、利用者が送信したメッセージ、友達情報および通知設定は削除され、復元できません。ただし、利用規約への同意記録、取引記録その他法令または紛争対応等のために必要な情報は、必要な期間に限り保管する場合があります。

Users may delete their account through the App’s settings screen. When an account is deleted, account information, messages sent by the user, friend information, and notification settings are deleted and cannot be restored. However, records of agreement to the Terms, transaction records, and other information required by law or necessary for dispute resolution may be retained for the necessary period.

アカウントまたは本アプリを削除しても、自動更新のサブスクリプションは自動的には解約されません。解約が必要な場合、利用者はお申し込みを行ったアプリストアで手続きを行う必要があります。

Deleting an account or the App does not automatically cancel an auto-renewing subscription. Users who wish to cancel must complete the cancellation process through the application store where they subscribed.

9. 利用者の請求および選択／User Requests and Choices

利用者は、法令の定めに従い、当方が保有する自己の個人情報について、開示、訂正、利用停止または削除等を請求できます。また、端末の設定からカメラ、マイク、音声認識および通知の許可を変更できます。ただし、必要な権限を許可しない場合、本アプリの一部機能を利用できないことがあります。

Subject to applicable law, users may request disclosure, correction, suspension of use, deletion, or other handling of their personal information held by us. Users may also change camera, microphone, speech-recognition, and notification permissions through their device settings. Some functions of the App may be unavailable if required permissions are not granted.

10. 安全管理措置／Security Measures

当方は、取得した情報への不正アクセス、漏えい、滅失または毀損を防止するため、アクセス制御、認証、通信の保護その他必要かつ合理的な安全管理措置を講じるよう努めます。ただし、インターネット上の通信または情報保管について、完全な安全性を保証するものではありません。

We endeavor to implement necessary and reasonable security measures, including access controls, authentication, and protection of communications, to prevent unauthorized access, leakage, loss, or damage. However, we cannot guarantee complete security for communications or information storage over the internet.

11. 未成年者の利用／Use by Minors

未成年者が本アプリの利用登録または有料サービスのお申し込みを行う場合は、親権者その他の法定代理人の同意を得るものとします。

Minors must obtain the consent of a parent or other legal representative before registering for the App or subscribing to a paid service.

12. プライバシーポリシーの変更／Changes to This Privacy Policy

当方は、法令の変更、本アプリの機能変更その他必要に応じて、本プライバシーポリシーを変更することがあります。重要な変更を行う場合は、本アプリ、当方のWebサイトその他適切な方法で周知します。

We may amend this Privacy Policy in response to changes in law, changes to the App’s functions, or other circumstances. Material changes will be announced through the App, our website, or another appropriate method.

第1条（本規約について）／Article 1 (About These Terms)

本規約は、ラハイナーズ合同会社（以下「運営者」といいます。）が提供する「おはようカモメ」（以下「本サービス」といいます。）の利用条件を定めるものです。利用者は、本規約に同意したうえで本サービスを利用するものとします。

These Terms of Service set forth the conditions for using “Ohayo Kamome” (the “Service”) provided by Lahainars LLC (the “Operator”). Users shall agree to these Terms before using the Service.

第2条（本サービスの目的）／Article 2 (Purpose of the Service)

本サービスは、家族や友人との日常的なコミュニケーションを支援するための簡易メッセージサービスです。本サービスは、緊急連絡、業務上重要な連絡、契約上重要な連絡その他重要な情報の伝達を目的としたものではありません。

The Service is a simple messaging service designed to support daily communication with family and friends. The Service is not intended for emergency contact, business-critical communication, contractually important contact, or the transmission of any other critical information.

第3条（利用登録）／Article 3 (User Registration)

利用者は、運営者が定める方法により利用登録を行い、登録情報を正確に管理するものとします。未成年者が利用登録または有料サービスのお申し込みを行う場合は、親権者その他の法定代理人の同意を得るものとします。

Users shall register for the Service in accordance with the method specified by the Operator and shall maintain accurate registration information. Minors must obtain the consent of a parent or other legal representative before registering for the Service or subscribing to a paid service.

第4条（利用者の責任）／Article 4 (User Responsibility)

利用者は、自己の責任において本サービスを利用するものとします。本サービスの設定、利用登録および本規約への同意は、利用者本人または本人の同意を得た代理人が行うものとします。利用者は、登録したメールアドレスおよびパスワードを適切に管理し、第三者に知らせてはなりません。運営者は、登録されたメールアドレスに、本サービスに関する通知を送信する場合があります。

Users shall use the Service at their own responsibility. Settings, registration for the Service, and agreement to these Terms shall be completed by the user or a representative authorized by the user. Users shall appropriately manage their registered email address and password and shall not disclose them to any third party. The Operator may send notifications concerning the Service to the registered email address.

第5条（禁止事項）／Article 5 (Prohibited Matters)

利用者は、次のいずれかの行為をしてはならない。法令または公序良俗に反する行為、他人になりすます行為、本サービスの運営を妨害する行為、他の利用者に迷惑を与える行為、その他運営者が不適切と判断する行為。

Users shall not engage in any of the following acts: acts that violate laws, regulations, public order, or morals; impersonating another person; interfering with the operation of the Service; causing a nuisance to other users; or any other act deemed inappropriate by the Operator.

第6条（個人情報およびメッセージ情報の取扱い）／Article 6 (Handling of Personal and Message Information)

運営者は、サービス提供、運用保守、サポート対応および障害調査のために必要な範囲で、利用者が送受信した情報を確認する場合があります。運営者は、確認した情報について適切な管理に努め、法令に基づく場合を除き、正当な理由なく第三者へ開示しません。本サービスは機密情報の保管を目的としたサービスではありません。暗証番号、銀行口座情報、クレジットカード情報、認証コード、個人番号その他重要な機密情報は送信しないでください。運営者は、個人情報保護法その他関連法令に従い、情報の適切な管理に努めます。

The Operator may review information sent and received by users to the extent necessary to provide and maintain the Service, respond to support requests, and investigate failures. The Operator shall endeavor to manage such information appropriately and shall not disclose it to third parties without a legitimate reason, except as required by law. The Service is not intended for storing confidential information. Users should not transmit PINs, bank-account information, credit-card information, authentication codes, individual identification numbers, or other important confidential information. The Operator shall endeavor to manage information appropriately in accordance with the Act on the Protection of Personal Information and other applicable laws.

第7条（音声入力機能）／Article 7 (Voice Input Function)

本サービスは、音声データを外部の処理サービスへ送信して文字へ変換する機能を提供します。音声認識の結果は常に正確であるとは限らず、無音、雑音その他の状況により、実際には発話していない内容が生成されるなどの誤変換が発生する場合があります。

The Service provides a function that sends voice data to an external processing service for conversion into text. Speech-recognition results are not always accurate, and silence, background noise, or other conditions may cause conversion errors, including the generation of text that was not actually spoken.

第8条（利用制限）／Article 8 (Usage Restrictions)

運営者は、録音時間、文字数、送信回数その他の利用制限を設ける場合があり、必要に応じてこれらを変更できるものとします。

The Operator may establish restrictions on recording time, character count, number of transmissions, and other usage, and may modify these restrictions as necessary.

第9条（メッセージおよびデータの取扱い）／Article 9 (Handling of Messages and Data)

メッセージや通知は、通信環境、端末の状態、外部サービスの障害その他の理由により、遅延、未達、消失等が発生する場合があり、通知バッジの数字も正確でない場合があります。運営者は、メッセージまたは通知の到達、即時性、保存期間を保証しません。古いメッセージは一定数を超えると自動的に削除される場合があるため、大切な情報は利用者自身で保存してください。運営者は、利用者データのバックアップおよび復旧を保証しません。アカウントを削除すると、アカウント、送信したメッセージ、友達情報および通知設定は削除され、復元できません。ただし、利用規約への同意記録など、法令または紛争対応等のために必要な情報は、必要な期間保管する場合があります。

Messages and notifications may be delayed, undelivered, or lost due to network conditions, device status, failures of external services, or other causes, and notification badge counts may be inaccurate. The Operator does not guarantee delivery, immediacy, or retention periods for messages or notifications. Older messages may be automatically deleted when they exceed a certain limit, so users should save important information themselves. The Operator does not guarantee backup or restoration of user data. When an account is deleted, the account, messages sent by the user, friend information, and notification settings are deleted and cannot be restored. However, records of agreement to these Terms and other information required by law or necessary for dispute resolution may be retained for the necessary period.

第10条（サービス内容の変更・停止）／Article 10 (Modification and Suspension of the Service)

運営者は、機能改善、保守、障害対応その他の理由により、本サービスの内容変更、一時停止または終了を行う場合があります。

The Operator may modify, temporarily suspend, or terminate the Service due to functional improvements, maintenance, failure response, or other reasons.

第11条（利用料金およびサブスクリプション）／Article 11 (Fees and Subscriptions)

本サービスは、自動更新の有料サービスです。利用料金は、運営者が定める方法により表示し、必要に応じて変更する場合があります。解約は利用者自身がアプリストアで行うものとし、アプリまたはアカウントを削除しても自動的には解約されません。お申し込み、更新、解約その他契約状況の確認・管理は利用者自身の責任で行うものとします。複数のお申し込み等により生じた料金その他の損害については、法令上運営者が責任を負う場合を除き、運営者は責任を負いません。

The Service is a paid service with automatic renewal. Fees will be displayed by methods specified by the Operator and may be changed as necessary. Users are responsible for canceling their subscriptions through the application store, and deleting the App or account does not automatically cancel a subscription. Users are responsible for checking and managing their subscription, renewal, cancellation, and other subscription status. Except where the Operator is liable under applicable law, the Operator shall not be liable for charges or other damages resulting from multiple subscriptions or similar circumstances.

第12条（利用制限およびアカウント停止）／Article 12 (Usage Restrictions and Account Suspension)

利用者が本規約に違反した場合、運営者は、事前の通知なく利用停止その他必要な措置を行うことがあります。

If a user violates these Terms, the Operator may suspend use of the Service or take other necessary measures without prior notice.

第13条（知的財産権）／Article 13 (Intellectual Property Rights)

本サービスに関するプログラム、画像、文章、画面デザインその他の権利は、運営者または正当な権利者に帰属します。

Rights to the programs, images, text, screen designs, and other materials relating to the Service belong to the Operator or their respective lawful rights holders.

第14条（免責事項）／Article 14 (Disclaimer)

運営者は、本サービスの継続性、完全性、正確性、即時性等を保証しません。通信障害、システム障害、サーバー障害、通知の遅延または未達、メッセージの遅延・消失、端末の故障、外部サービスの障害その他の事由により生じた損害については、法令上運営者が責任を負う場合を除き、運営者は責任を負いません。

The Operator does not guarantee the continuity, completeness, accuracy, or immediacy of the Service. Except where the Operator is liable under applicable law, the Operator shall not be liable for damages arising from communication failures, system failures, server failures, delayed or undelivered notifications, delayed or lost messages, device failures, failures of external services, or other causes.

第15条（規約の変更）／Article 15 (Modification of These Terms)

運営者は、法令に従い、必要に応じて本規約を変更することができます。変更する場合は、変更内容および効力発生日を、効力発生前に本サービス、運営者のWebサイトその他適切な方法で周知します。法令上利用者の個別の同意を必要としない変更は、周知した効力発生日から適用し、個別の同意が必要な変更については、改めて同意を得るものとします。

The Operator may modify these Terms as necessary in accordance with applicable law. The Operator will announce the changes and their effective date before they take effect through the Service, the Operator’s website, or another appropriate method. Changes that do not require individual consent under applicable law will apply from the announced effective date, while consent will be obtained again where individual consent is required.

第16条（準拠法および管轄）／Article 16 (Governing Law and Jurisdiction)

本規約は日本法に準拠し、本サービスに関する紛争については、運営者所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

These Terms shall be governed by the laws of Japan. Any dispute arising from or relating to the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Operator as the court of first instance.

附則／Supplementary Provisions

本規約は、運営者が定める日から施行します。

These Terms shall take effect on the date specified by the Operator.
